A. Estimates and Pricing

  • Quotes: All pricing provided for repair labor, parts, or maintenance contracts are considered estimates until a formal, written, and signed service agreement or contract is executed by both parties.
  • Diagnostic Fee: A standard, non-refundable diagnostic fee may apply to on-site visits, which may be waived upon acceptance of the repair or entry into a maintenance contract.

B. Scheduling and Service Commitment

  • Service Delivery: We commit to providing rapid, professional, and reliable Service. However, any commitment to a “same-day fix” or specific response time is a goal, not a guarantee.
  • Delays: We are not liable for delays caused by factors outside of our control, including but not limited to:
    • Unforeseen parts delays (especially for older/legacy equipment).
    • Traffic, weather conditions, or technician illness.
    • Customer unavailability or lack of access to equipment.
  • Customer Cooperation: The Customer must cooperate with our technicians and ensure easy, safe access to the equipment and necessary utilities (e.g., power, network connection) to facilitate efficient service.

C. Repair Limitations and Exclusions

  • Authorization: By requesting on-site or remote Service, you authorize our certified technicians to perform necessary diagnostics and repairs, which may include accessing device settings, network configuration, and internal components.
  • Replacement Parts: We may use new, remanufactured, or refurbished parts or assemblies during the repair process. All defective parts removed become the property of Copier Repair Des Moines unless otherwise agreed in writing.
  • Exclusions: Service does not cover damage or failure resulting from:
    • Improper use, neglect, or lack of maintenance by the Customer.
    • Repair or service attempts by unauthorized personnel (other than our technicians).
    • Connection to incompatible equipment or improper installation.
    • External factors such as power surges, acts of nature, fire, or vandalism.

D. Data Protection and Responsibility

  • Customer Responsibility: The Customer is solely responsible for backing up all data, software, and files stored on or connected to the equipment before Service commences.
  • No Liability for Data Loss: We shall not be liable for any loss, corruption, or compromise of data, programs, or confidential information resulting from the Service or device failure.

3. Website Use and Intellectual Property

A. Site Content

  • Informational Use: The content on the Site is for general information purposes only and is subject to change without notice.
  • Accuracy: While we strive for accuracy, we make no guarantees regarding the completeness, precision, or reliability of any information, pricing, or product compatibility listed on the Site.

B. Intellectual Property

  • All content, logos, text, graphics, and code on the Site are the exclusive property of Clear Choice Technical Services or its licensors and are protected by copyright and intellectual property laws.

4. Limitation of Liability and Indemnification

To the maximum extent permitted by Iowa law, in no event shall Copier Repair Des Moines or its parent organization, Clear Choice Technical Services, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

Our total liability to the Customer for any claim arising out of the Services shall not exceed the amount paid by the Customer for the specific Service that is the subject of the claim.

B. Indemnification

You agree to defend, indemnify, and hold harmless Copier Repair Des Moines and Clear Choice Technical Services, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (i) your use of and access to the Site or Services; (ii) your breach of any of these Terms.

  • Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions.
